The goal of this interview is to assist the user in determining whether an adult guardianship is the right option and to begin the filing process.

See a sample of the petition here.

Answering these questions should take approximately 30-45 minutes to complete. You have the option to save the interview and come back to it later. Once you have completed this interview, you will be prompted to download the Adult Guardianship Petition.

Also note that once you begin the interview, the interview will refer to the incapacitated individual that this guardianship petition is for as the "Respondent" because that is how they are referred to in all court documents. An Incapacitated Person (I.P.) is someone who is determined by the Court to have a clinically diagnosed condition that leaves them unable to make or communicate decisions affecting their physical health, safety, or self-care. A person is not “incapacitated” just because they are elderly. The Guardian appointed by the court for an I.P. will make some or all decisions for the I.P. If the I.P. requires medical treatments or care that the court considers “extraordinary,” a guardian must obtain the Court’s permission before authorizing the treatment.

Disclaimer: Completing this interview does not give you any legal rights and is not intended as a substitute for legal advice. You should contact an attorney to obtain legal advice with respect to any particular issue or concern. Use of and access to this interview or any links contained within do not create an attorney-client relationship. You will need to file these documents with the court and a judge will make the decisions about your case. This interview is for informational purposes only.
